Acceptance of terms* By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
* TestFlight builds are pre-release and may be incomplete, change rapidly, and contain bugs.
Eligibility* The Service is intended for individuals 18 years or older. By using the Service, you confirm you are at least 18 and have legal capacity to agree to these Terms.
* The Service is not directed to children. Do not use the Service if you are under 18.
* The App Store age rating reflects content, not legal eligibility; you must be 18+ to use Daybeam.
Health & safety notice (no medical advice)* Daybeam provides guided visualization and related content for wellbeing and motivation. It is not medical, psychological, or therapeutic advice and is not a substitute for professional care.
* Do not use the Service for emergencies. If you are in crisis or think you may harm yourself or others, call local emergency services immediately (in the U.S., dial 988 for the Suicide & Crisis Lifeline).
* Using Daybeam does not create a therapist-patient, coach-client, or any professional relationship.
AI content & safety filtering* Daybeam uses artificial intelligence to generate short visualization scripts and audio. AI may produce errors, contradictions, or unexpected outputs (“hallucinations”). Do not rely on AI for factual information or important decisions.
* We apply conservative safety filters and may block inputs that imply violence, self-harm, sexual activity, criminal activity, or unsafe behavior. Our filters may over-block; access is not guaranteed.
* Assumption of risk. You acknowledge AI-generated content may be unpredictable despite safety measures. You are responsible for your use of the content and for discontinuing use if content feels unhelpful or distressing.
* You will not attempt to bypass or interfere with our content or safety filters.
License to use* We grant you a limited, non-exclusive, non-transferable license to install and use the app on iOS devices you own or control, solely for personal, non-commercial use and in accordance with these Terms and the Apple Media Services terms.Subscriptions; in-app purchases* Certain features require a paid subscription managed by Apple In-App Purchase and RevenueCat for entitlements. Apple’s terms and your App Store country’s pricing apply.
* Trials renew automatically to a paid subscription unless canceled at least 24 hours before the period ends. Cancellation and refunds are managed by Apple.
* If you start a paid subscription before a free trial ends, any unused trial period is forfeited upon purchase.
* You can manage or cancel your subscription in Apple Settings → Subscriptions.
* Restore. You can restore purchases from within the app.
User content* You may create or upload content (e.g., audio recordings). You retain ownership of your content.
* You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use your content only as needed to operate, maintain, and secure the Service (for example, transient processing via our proxy/providers and technical diagnostics). We do not use your content to train AI models.
* You represent you have the rights to submit content and that your content and use comply with these Terms.
Feedback* If you send ideas, feature requests, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate them into the Service without compensation.AI outputs* To the extent permitted by law, you may use AI-generated scripts and audio the Service creates for you for your personal, non-commercial purposes. We and our licensors retain all rights in the Service, models, and prompts.
* Personal use includes personal social sharing. Contact us for commercial licensing.
Acceptable use* You will not: (i) misuse or interfere with the Service; (ii) submit unlawful, harmful, or infringing content; (iii) reverse engineer or circumvent access controls; (iv) use the Service for commercial or advertising purposes; or (v) attempt to access features without a valid entitlement.
* We may remove content, limit functionality, or suspend access to protect users and the Service.
* You will not attempt to bypass, disable, or interfere with any content moderation or safety filters.
* Do not record others without any legally required consent; you are responsible for complying with recording and privacy laws.
Intellectual property* The Service (including the “Daybeam” name, visuals, designs, and code) is owned by Long Way Studio LLC and its licensors. No rights are granted except as expressly stated.MVP & TestFlight notice* Daybeam is an early-stage product and may contain bugs, incomplete features, or unexpected behavior. You accept the experimental nature of the Service, particularly for TestFlight builds.Third-party services; Apple as third-party beneficiary* The Service integrates Apple (IAP and TestFlight), RevenueCat (entitlements), Cloudflare (proxy), OpenAI (AI processing), Sentry (error reports), and PostHog (analytics). Your use must comply with applicable platform/provider acceptable-use rules.
* These providers act as our service providers/processors.
* Apple (and Apple’s subsidiaries) are third-party beneficiaries of these Terms and may enforce them as they relate to your licensed use of the iOS app.
* Support and maintenance are provided by Long Way Studio LLC (not Apple). Apple has no warranty obligation for the app and is not responsible for claims related to the app.
Diagnostics & crash logs* We design our telemetry to exclude user content. We do not record or store your intention audio, transcripts, prompts, or synthesized speech in analytics or crash reporting; we collect only technical metadata (e.g., timestamps, error codes, device/OS/app versions).
* In uncommon OS-level crash scenarios, an operating system crash report or third-party SDK may include a short, non-searchable fragment of in-memory text. When that happens, we:
(i) prevent payload/body capture and strip event context where possible;
(ii) automatically redact known sensitive fields prior to processing;
(iii) retain any crash payloads at most 30 days; and
(iv) honor deletion requests tied to your User ID (Support ID), deleting within 7 days of verification.
* Nothing in this section obligates us to retain logs; we may delete diagnostic data sooner in our discretion.
Washington consumer health data* Some information you provide (e.g., wellbeing reflections) may be considered consumer health data under Washington law. We apply the practices described in our Privacy Policy to protect this information.Export controls & sanctions* You must comply with U.S. and other applicable export and sanctions laws. You may not use the Service where prohibited.Disclaimer of warranties* THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.Limitation of liability* TO THE MAXIMUM EXTENT PERMITTED BY LAW, LONG WAY STUDIO LLC AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, USE, OR GOODWILL.
* OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR USD $50, WHICHEVER IS GREATER.
* No personal liability of individual members, managers, directors, or officers of Long Way Studio LLC shall arise from your use of the Service.
Indemnity* You will defend, indemnify, and hold harmless Long Way Studio LLC from claims arising out of your use of the Service or violation of these Terms.Arbitration; class-action waiver* Binding arbitration. Any dispute will be resolved by individual binding arbitration administered by the AAA under its Consumer Arbitration Rules, with venue in Washington State.
* Small claims exception. Either party may bring an individual action in a court of competent jurisdiction for matters within that court’s scope.
* No class actions. You and we waive the right to participate in class or representative actions or proceedings.
* Opt-out. You may opt out within 30 days of first accepting these Terms by emailing [email protected] with subject “Arbitration Opt-Out”, including your name and User ID (Support ID) (Settings → Support → Copy). We may request reasonable proof of first use (e.g., approximate first-use date or device identifier).
* Informal resolution. Before filing arbitration, the complaining party must email [email protected] a notice describing the claim and requested relief and the User ID (Support ID). If the parties don’t resolve the claim within 30 days, either may start arbitration.
* Mass filings. If 25 or more similar demands are filed by or with the same counsel, the parties will select a small number of bellwether cases to proceed first; the rest are stayed pending those outcomes. Administrative issues may be consolidated.
* This section survives termination.
Changes; termination* We may change the Service or these Terms at any time. Material changes will take effect 7 days after we post the update (except updates required by law or for new features). Arbitration terms apply prospectively from the effective date unless you expressly agree otherwise. Continued use after changes means you accept them.
* We may suspend or terminate the Service or your access at any time. You may stop using the Service and uninstall the app at any time.
Governing law* These Terms are governed by the laws of the State of Washington, excluding its conflicts rules, and applicable U.S. federal law.Entire agreement; severability; assignment* These Terms are the entire agreement between you and Long Way Studio LLC regarding the Service. If any provision is unenforceable, the rest remain effective. We may assign these Terms; you may not assign without our consent.AccessibilityWe want Daybeam to be usable by as many people as possible. Daybeam supports major iOS accessibility features (including VoiceOver, Dynamic Type, Reduce Motion, and Increase Contrast), and we’re continually improving.If you encounter an accessibility barrier, please contact us at [email protected] or use the in-app “Report Accessibility Issue” link in Settings. Include your Support ID (Settings → Support → Copy) so we can locate relevant diagnostics.Because Daybeam is a new app and still evolving, some features may not work with all assistive technologies at all times. This statement describes our current approach and improvement process; it is not a guarantee of conformity with any particular standard. Nothing in this section limits other Terms (including Warranty and Liability).

Summary (plain language)* We don’t run ads and don’t sell your data.
* We don’t have user accounts.
* Your session audio/transcripts/generated audio are stored on-device. We don’t store this content on our servers beyond transient processing.
* We use a random User ID (Support ID) to reference your device across PostHog (US cloud), Sentry, RevenueCat, and our Cloudflare Worker logs, and we do not send it to AI providers.
* We do not log your intention/script text in analytics, proxy logs, or crash reporting. In uncommon OS-level crash scenarios, a short, non-searchable fragment of in-memory text might be included by the operating system or a third-party SDK. When that occurs, we automatically redact known sensitive fields, avoid storing request bodies, keep any crash payloads at most 30 days, and honor deletion requests tied to your Support ID (deleted within 7 days of verification).
* OpenAI model training is disabled for our organization. OpenAI may retain certain API logs (including inputs/outputs) for up to 30 days for abuse monitoring and reliability.
* US-only availability at launch.
* You can request access/deletion using your User ID (see “Your privacy rights” below).
Data we collect* App telemetry & diagnostics. Crash reports (Sentry), performance metrics, basic device/application metadata (e.g., app version, OS version), event counts (PostHog).
* Purchase & entitlement data. Receipts and subscription status via Apple and RevenueCat (we don’t receive your full billing details).
* Network logs (proxy). Our Cloudflare Worker routes select AI requests; it logs routing metadata (timestamps, status codes) and the User ID. We do not log intention/script text at the proxy, and we do not forward the User ID to OpenAI.
* Support communications. If you email [email protected], we process and retain your message and address to respond and maintain support records.
* Website analytics (if enabled). Our site may use non-advertising analytics (e.g., PostHog US cloud). Tools may set cookies or local storage solely to measure traffic and features.
Diagnostics & crash-log safeguards* We configure analytics and crash reporting to exclude user content (no prompts/transcripts/TTS scripts or audio).
* We do not attach request bodies or chatty contexts to error events and regularly strip breadcrumbs/extra fields that could carry text.
* In uncommon OS-level crashes where a short fragment could appear, we auto-redact known sensitive patterns, retain payloads at most 30 days, and will delete on request within 7 days after verifying your Support ID.
Data we avoid* No user accounts or profile fields.
* No address book, photos (beyond what you intentionally share via OS mechanisms), precise location, or motion activity.
* No ad networks; no cross-context behavioral advertising.
How we use data* Operate core features (recording, transcription, script generation, TTS playback).
* Determine and restore subscription entitlement status.
* Debug, test, secure, and improve the Service (including pre-release TestFlight).
* Measure high-level usage (e.g., session counts) to find product-market fit without personal profiling.
AI processing & providers* What’s sent. To create your session’s script and audio, we send your recording (or transcription) and related prompts to our AI provider through our secure Cloudflare proxy.
* Provider. We use the OpenAI Platform API. Model training is disabled. OpenAI may retain certain API logs (including inputs/outputs) for up to 30 days for abuse monitoring and service reliability. This retention is outside our direct control.
* Identifiers. We do not attach your User ID to AI requests unless required for reliability. We avoid sending personal identifiers to OpenAI.
* Your choices. You can minimize exposure by avoiding personal details in inputs or by not using AI features.
TestFlight participants* TestFlight may include additional Apple diagnostics. Beta features can have incomplete privacy controls. Participation is voluntary and can be ended by uninstalling.Accessibility preferences (local-only).The app reads certain iOS accessibility settings (e.g., VoiceOver state, text size, Reduce Motion, Increase Contrast) on-device to adapt the UI. We do not collect or transmit these settings to our servers or analytics providers. If you voluntarily share information about accessibility needs or a disability, we use it only to investigate and resolve your support request and to maintain necessary support records.Washington consumer health data* Some information you provide (e.g., wellbeing reflections) may be “consumer health data” under Washington law. We apply the collection, use, and disclosure limits in this Policy to such data. We do not sell consumer health data. We use it only to provide and improve the Service.
* Categories & sources. If you share reflections about wellbeing, we process those only to generate your session (from your recording/transcript) and to operate the Service.
* Purposes. Provide session generation (Whisper → script → TTS), keep the Service secure and reliable, measure high-level usage, and handle support.
* Sharing. We share with processors only (Apple IAP, RevenueCat, Cloudflare, OpenAI, Sentry, PostHog). We do not sell consumer health data.
* Consent. Your use of these features is a clear affirmative action to process this data only for the purposes above.
* Your choices. Avoid including personal details; you can request access/deletion via your User ID.
* Geofencing. We do not use geofencing around health facilities.
Legal bases (where applicable)* We process data to perform the contract (provide the Service), for our legitimate interests (safety, security, improvement), and to comply with legal obligations.Retention* App analytics events may be retained up to 7 years by our analytics provider. Crash diagnostics (including any rare OS-level fragments) are retained no longer than 30 days.
* OpenAI may retain certain API logs for up to 30 days.
* Apple/RevenueCat purchase records are retained as required for transaction integrity, fraud prevention, and accounting.
* Support emails are retained for as long as reasonably necessary to provide support and maintain records.
Sharing* Processors only. We share data with service providers acting on our behalf: Apple (IAP), RevenueCat (entitlements), Cloudflare (proxy), OpenAI (processing), Sentry (errors), PostHog (usage analytics).
* No sale; no ads. We do not sell personal information or share it for cross-context behavioral advertising.
* Law & safety. We may disclose information if required by law or to protect users and the Service.
Security* We use technical and organizational measures appropriate to our size and the nature of the Service. No method of transmission or storage is 100% secure.Your privacy rights (US states)* Depending on your state, you may have rights to access, correct, delete, or obtain a copy of certain information.
* Because we do not maintain user accounts, we may only be able to locate records using your User ID.
* If available in your app version, we may also verify using a purchase token associated with your account (for example, Apple’s appAccountToken).
* To exercise a right, email [email protected] with your User ID (Settings → Support → Copy).
* We do not sell personal information or share it for cross-context behavioral advertising.
Appeals & authorized agents* If we decline your request, you can appeal by emailing [email protected] with subject “Privacy Appeal” and your User ID.
* You may submit requests via an authorized agent. We may need to verify your identity and your agent’s authority (for example, via your User ID and a short written permission).
Children’s privacy* The Service is not directed to children and is intended for adults 18+. We do not knowingly collect information from children. If we learn a child has provided information, we will delete it upon notice.
* The App Store age rating reflects content guidelines, not legal eligibility; Daybeam is intended for adults 18+.
International* The Service is offered US-only at launch. Data is processed in the United States and may be processed by our U.S.-based providers.Critical: Save your User ID* We cannot identify you without your User ID (found in Settings → Support).
* Before uninstalling: Save your User ID if you may want data deletion later.
* Without your User ID, we may be unable to locate or delete analytics logs associated with your device.
Your choices* We don’t offer an in-app opt-out for basic analytics or crash reports. Some OS-level settings may affect diagnostic sharing with Apple, but they do not control our analytics providers. To avoid analytics/crash reporting, you can stop using the Service.
* You can avoid sending personal details in recorded inputs.
