- By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
- If you access pre-release TestFlight builds, you acknowledge features may be incomplete, may change, and may contain bugs.Eligibility
- The Service is intended for individuals 13+ (or 16+ where applicable). By using the Service, you confirm you meet the minimum age requirement and have legal capacity to agree to these Terms.Health & safety notice (no medical advice)
- Daybeam provides guided visualization and related content for wellbeing and motivation. It is not medical, psychological, or therapeutic advice and is not a substitute for professional care.
- Do not use the Service for emergencies. If you are in crisis or think you may harm yourself or others, call local emergency services immediately.License to use
- We grant you a limited, non-exclusive, non-transferable license to install and use the iOS app on an Apple-branded device you own or control, solely for personal, non-commercial use and in accordance with these Terms and Apple’s applicable terms.Subscriptions & in-app purchases
- Some features are available via an auto-renewing subscription purchased through Apple In-App Purchases. We use RevenueCat to manage entitlements (access state). Prices are shown in-app and may vary by region.
- Billing & renewal. Apple bills your Apple ID. Your subscription renews automatically unless canceled at least 24 hours before the end of the current period.
- Free trials. If offered, trials convert to a paid subscription unless canceled before the trial ends. Eligibility and duration may vary.
- Cancel & manage. You can view, change, or cancel in Settings > Apple ID > Subscriptions on your device. We cannot cancel for you.
- Refunds. Refunds (including for accidental purchases) are handled by Apple, subject to Apple’s policies.
- Entitlement restore. You can restore purchases from within the app (uses Apple/RevenueCat to re-validate access).User content
- You may create or upload content (e.g., in-app audio recordings) while using the Service. You retain ownership of your content.
- You grant us and our service providers a license to process your content solely to operate and improve the Service, consistent with our Privacy Policy.
- You are responsible for your content and must ensure you have all rights necessary to submit it.Acceptable use
- You agree not to misuse the Service, including by: reverse engineering; interfering with or disrupting servers or networks; attempting to gain unauthorized access; using the Service for unlawful, harmful, or infringing purposes; or circumventing access controls or subscription mechanisms.Intellectual property
- The Service (including text, graphics, logos, the “Daybeam” name, visual designs, animations, and software) is protected by intellectual property laws and remains the property of Long Way Studio LLC and its licensors.Third-party services
- We rely on trusted providers to operate the Service (e.g., Apple TestFlight and In-App Purchases, RevenueCat, Cloudflare, OpenAI, Sentry, PostHog). Your use of Apple-provided functionality is also governed by Apple’s terms.Arbitration & class action waiver
- Binding arbitration. Except for disputes that qualify for small claims court, you and we agree to resolve any dispute arising out of or relating to these Terms or the Service through individual, binding arbitration under the AAA Consumer Arbitration Rules. Arbitration will take place in Kitsap County, Washington, or by video/teleconference as permitted by the rules.
- No class actions. You and we agree that each may bring claims against the other only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
- Injunctive relief. Either party may seek temporary or preliminary injunctive relief in court to protect its rights pending arbitration.
- Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with subject “Arbitration Opt-Out” and including your name and the email tied to your device/App Store account. Opting out does not affect other provisions of these Terms.Termination
- You may stop using the Service at any time and may uninstall the app. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users.
- Upon termination, the rights granted to you under these Terms end, but sections that by their nature should survive (e.g., Intellectual property, Arbitration & class action waiver, Disclaimers, Limitation of liability) will survive.Disclaimers
- THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.Limitation of liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, LONG WAY STUDIO LLC AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR PROFITS.
- OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.Indemnification
- You agree to indemnify and hold Long Way Studio LLC harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms.Governing law & venue
- These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles.
- For any matter that proceeds in court (e.g., small-claims, injunctive relief), you agree to the exclusive jurisdiction and venue of state courts in Kitsap County, Washington, and federal courts in the U.S. District Court for the Western District of Washington.Region
- The Service (including TestFlight and initial App Store release) is intended for use in the United States only. Availability may change over time.Changes to these Terms
- We may update these Terms from time to time. If we make material changes, we will update the Effective date above and, where appropriate, provide additional notice in the app or on the website. Continued use of the Service after changes take effect constitutes acceptance.Privacy

- Microphone audio you record in the app to create your Daybeam experience.
- Subscription choice (e.g., monthly or annual) when you initiate an in-app purchase. Apple processes the payment. We do not receive your card or billing details.Not collected
- We do not collect your name, email address, phone number, contacts, photos, precise location, or advertising identifiers. There are no accounts in this TestFlight build.Collected automatically
- Diagnostics & crash data (e.g., crash logs, performance metrics) to troubleshoot stability issues.
- Basic product analytics (low-volume) such as feature usage, device/OS version, session timing, and error rates.
- Purchase events necessary to operate subscriptions (e.g., product identifier, transaction status, subscription period, storefront/country code), validated via Apple receipts and managed via RevenueCat. We do not receive your full payment information.
- Network metadata (e.g., IP address) may be processed transiently by infrastructure for delivery and security.How we use data

- To debug, test, and improve Daybeam during the TestFlight period.

- We use trusted providers to operate the test build; they act as processors on our behalf and are not permitted to use your data for their own marketing: Apple TestFlight (distribution and tester management), Apple In-App Purchases (payment processing and receipt issuance), RevenueCat (subscription/entitlement management and receipt validation), Cloudflare Workers (secure API proxy), OpenAI (third-party AI APIs used to provide features), Sentry (crash and performance diagnostics), and PostHog (product analytics configured without PII).Where data lives & retention
- On your device: Session artifacts (e.g., audio you generate and related local files) are stored locally on your iPhone and are removed when you delete them or uninstall the app.
- Subscriptions: Apple issues receipts; RevenueCat maintains subscription/entitlement records needed to reflect your access state. On-device we keep minimal flags (e.g., whether you are currently entitled).
- Processing: Audio and related content may be processed by our infrastructure and trusted providers to deliver features. We do not retain this content on our servers beyond transient processing or short-lived operational logs.
- Analytics & crashes: Retained up to 24 months, then deleted or aggregated.Your choices
- Subscriptions are managed by Apple. You can view, change, or cancel your subscription in iOS Settings > Apple ID > Subscriptions. Refunds are handled by Apple.
- You can Restore Purchases from within the app (uses Apple/RevenueCat to re-validate entitlements).
- There is no in-app opt-out for analytics in this TestFlight build. You can stop participating at any time by uninstalling the TestFlight app.
- You may request deletion of server-side analytics or diagnostic records associated with your tester device by emailing [email protected] (include your device model and TestFlight build number).Security
- We use industry-standard measures, including encryption in transit (TLS) and restricted access. No method of transmission or storage is 100% secure.Children
- Daybeam (TestFlight) is not intended for children under 13 (or under 16 where applicable). We do not knowingly collect personal data from children in this testing program.Region
- The Daybeam TestFlight program is intended for use in the United States only. Data is processed in the United States.Changes
